Probable Cause

  • Definition: Probable cause is based on actual facts or evidence indicating that a person has committed, is committing, or will commit a crime. This standard is required for conducting searches and making arrests.

Application: Probable cause must be supported by concrete evidence, such as observing a drug transaction or other criminal activity. This level of evidence allows officers to search and arrest suspects.
