Purpose of Internal Affairs
The purpose of this document is to outline the official investigative procedure for any Officer(s) involved in an incident under Internal Affairs (IA) investigation. These procedures ensure thorough, impartial investigations while maintaining procedural integrity.
Internal Affairs Investigation Procedure
Initial Response and Officer Involvement
Step 1.1: Officer Notification
Any Officer(s) involved in an incident or complaint under investigation will be promptly notified by IA.
The officer will be instructed to report to IA for an initial interview to provide their side of the story.
Step 1.2: Officer Interview
Before any interview is conducted Officer(s) will be read their Garrity Warning.
IA will conduct an interview with the involved Officer(s) to gather their account of the incident.
The Officer(s) will be given an opportunity to explain their actions, provide relevant context, and submit any supporting evidence or statements.
Step 1.3: Temporary Relief from Duty
Depending on the severity of the incident, the involved Officer(s) may be placed on immediate administrative leave for up to 24 hours while the investigation is ongoing.
This period allows IA to collect additional evidence, conduct interviews, and begin the investigative process without any interference or undue stress on the Officer(s) involved.
Investigation and Witness Testimony
Step 2.1: Gathering Witness Testimony
IA will conduct interviews with all relevant witnesses, including other Officers, civilians, and any individuals who may have observed the incident.
Any available evidence will be reviewed and incorporated into the investigation.
Step 2.2: Comprehensive Analysis
IA will review all gathered evidence, compare witness testimonies, and analyze the actions taken by the Officer(s) involved.
The goal is to establish a clear, objective understanding of the incident from all perspectives.
Review and Recommendation
Step 3.1: Presentation to High Command
Once the investigation is complete, IA will compile a detailed report outlining the facts of the case, witness statements, and any other pertinent information.
The report will be presented to High Command or the Chief of Police for review.
Step 3.2: Discussion and Decision
IA will engage in discussions with the relevant department heads to review the facts of the case and listen to their input regarding potential disciplinary measures or corrective actions.
IA retains the authority to make the final determination regarding any disciplinary action to ensure that they are fair, consistent, and aligned with the department’s policies, values, and established protocols.
Final Communication and Outcome
Step 4.1: Notification of Decision
IA will schedule a meeting with the involved Officer(s) to communicate the final decision.
All involved parties will have the opportunity to ask questions regarding the outcome.
Step 4.2: Outlining Next Steps
During the meeting, IA will outline any further actions, training, or corrective steps that are required as a result of the incident.
If necessary, IA will provide the Officer(s) with a clear path for rehabilitation, further investigation, or appeals if applicable.
Step 4.3: Documentation
All investigation records, witness statements, findings, and disciplinary actions will be properly documented and maintained for future reference.
